Memorandum Of Agreement Between Law Enforcement And Education

The annual MOA review allows school and law enforcement officials to reaffirm their commitment to cooperate as partners, discuss the effectiveness of ongoing processes and review procedures when needed. It is important that school officials are familiar with this agreement and that it supports safe learning environments. In 1988, the New Jersey Departments of Law – Public Safety and Education issued a memorandum of understanding on the use of local law enforcement and education services. These agreements have been signed in municipalities across the state and have demonstrated the commitment of the two institutions to cooperate as equal partners in addressing the state`s alcohol and other drug problems with school-age children. The regulations adopted by the National Board of Education and codified in N.J.A. . C A:16-6.2 (b)13 to 14) establish uniform national policies and procedures to ensure cooperation between education officials and law enforcement agencies; These policies and procedures are consistent with the agreement approved by the Attorney General and the Commissioner for Education regarding the Single State Agreement between Education and Prosecution Officials (MOA). On January 8, the New Jersey Department of Education (NJDOE) issued the new Memorandum of Understanding (MOA) between education and the right to enforce. The MOA was designed to ensure cooperation between law enforcement and education officers and ultimately to protect the educational environment. Recent events in New Jersey and across the country have shown that schools are generally safe places for students and staff, but that a large number of crimes are committed on school grounds. All schools are required to adopt and implement this revised MOA for the 2018-2019 school year.

Previous revisions were also approved in 1992, 1999, 2007 and 2011. While school districts are free to adapt the MOA to include additional local provisions to address specific problems and concerns, districts are not allowed to remove or amend MOA provisions in accordance with the N.J.A.C 6A:16-6.2 (b)14ii.
