On 6 September 2020, the Financial Times reported that the UK government was considering drafting new laws to circumvent the protocol of the Northern Ireland Withdrawal Agreement. [45] The new law would give ministers the power to determine which state aid should be notified to the EU and to define which products at risk of being transferred from Northern Ireland to Ireland (the withdrawal agreement stipulates that in the absence of a reciprocal agreement, all products are considered vulnerable). [47] The government defended this approach and stated that the legislation was in accordance with protocol and that it had only “clarified” the volumity in the protocol. [48] Ursula von der Leyen warned Johnson not to violate international law and said that the implementation of the withdrawal agreement by Britain was a “precondition for any future partnership”. The arbitration panel`s decision is notified to the EU and the United Kingdom and to the Joint Committee within 75 days of filing the application. The reception of the agreement in the House of Commons ranged from cold to hostile, and the vote was delayed by more than a month. Prime Minister May has received a motion of no confidence within her own party, but the EU has refused to accept further changes. The United Kingdom ensures that all specific obligations arising from Community agreements with third countries or international organisations concerning nuclear equipment, nuclear materials or other nuclear elements present in the United Kingdom at the end of the transition period are fulfilled, or to conclude, by other means, appropriate arrangements in agreement with the third country or an international organisation concerned. REMEMBERing the commitments made by the EU and the United Kingdom in the joint report of EU and UK negotiators on progress made in the first phase of the EU Article 50 negotiations on the UK`s orderly withdrawal from the European Union, from 8 December 2017, 8. A subsequent agreement between the EU and the United Kingdom indicates the parts of this protocol that it is taking as a replacement.

As soon as a subsequent agreement between the EU and the United Kingdom enters into force after the withdrawal agreement enters into force, this Protocol does not apply, in whole or in part, from the date of application of this subsequent agreement and in accordance with the provisions of this agreement, which specify the consequences of that agreement on it.
